In this document, “Company”, “we”, “our”, or “us” refers to TranscribeText. “Services” means the transcription platform and any related products we provide, whether accessed via web browser, mobile application, API, or any other format. “You” or “your” refers to the individual or organisation that holds an account with our Services.

By using our Services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

We may update these Terms from time to time. Material changes will be indicated by updating the date at the top of this page. Your continued use of the Services after such changes constitutes acceptance of the updated terms.

Account Terms

• You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation.
• You may not use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
• You are responsible for all content uploaded and all activity that occurs under your account, including content uploaded by others who have access to your login credentials.
• Accounts must be registered by a human. Accounts created by automated methods (“bots”) are not permitted.

Acceptable Use

You agree not to use the Services to:

• Upload or transcribe content that infringes any third party’s intellectual property or privacy rights
• Process content containing illegal material
• Attempt to gain unauthorised access to our systems or other users’ accounts
• Interfere with or disrupt the integrity or performance of the Services
• Use the Services in any manner that could damage, disable, or impair our infrastructure

We reserve the right to suspend or terminate accounts that violate these terms.

Service Description

TranscribeText provides automated audio and video transcription services. While we strive for accuracy, transcription output is generated by artificial intelligence and may contain errors. You are responsible for reviewing and verifying all transcriptions before use.

We do not guarantee any specific level of accuracy, and transcriptions should not be relied upon for legal, medical, or other critical purposes without independent verification.

Payment, Refunds, and Plan Changes

• For paid Services that offer a free trial, the trial length is specified at sign-up. After the trial period, payment is required to continue using the Service.
• If you upgrade from a free plan to a paid plan, your card will be charged immediately and your billing cycle begins on the day of upgrade.
• All fees are exclusive of taxes, levies, or duties imposed by taxing authorities. Where required, we will collect and remit applicable taxes. Otherwise, you are responsible for payment of all applicable taxes.
• All purchases are non-refundable unless otherwise required by law. You may cancel paid services at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Cancellation and Termination

• You may cancel your account at any time through your account settings. Email or phone requests alone do not constitute cancellation. If you need assistance, please contact us.
• Upon cancellation, your content will become immediately inaccessible. Within 90 days, all content will be permanently deleted from our systems, including backups. This data cannot be recovered once deleted.
• We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abusive behaviour toward our staff, or activities that negatively impact the Services or other users.

Intellectual Property

• Your Content: You retain all ownership rights to the content you upload. By using our Services, you grant us a limited licence to process your content solely for the purpose of providing the transcription service.
• Our Services: The design, features, and functionality of the Services are owned by the Company and protected by copyright and other intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Services without our express written permission.
• Output: Transcriptions generated from your content belong to you. We claim no ownership over transcription output.

Privacy and Data

Your privacy is important to us. Please refer to our Privacy Policy for information about how we collect, use, and protect your data.

You represent that you have obtained all necessary consents to upload and process any content containing personal information or third-party voices.

Uptime and Availability

We provide the Services on an “as is” and “as available” basis. While we strive for high availability, we do not guarantee uninterrupted access and do not offer service-level agreements.

We reserve the right to temporarily limit or suspend access to your account if your usage significantly exceeds normal patterns or negatively impacts other users.

Disclaimer of Warranties

The Services are provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be error-free, secure, or available at all times, or that transcription output will be accurate or suitable for any particular purpose.

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.

Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless the Company and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to conflict of law principles.
